Amendments to the Common Regulations under the Madrid Agreement and Protocol entered into force

The Common Regulations under the Madrid Agreement Concerning the International Registration of Marks and the Protocol Relating to that Agreement were amended by the Assembly of the Madrid Union. Particularly, changes have affected the Rules 5 “Irregularities in Postal and Delivery Services and in Communications Sent Electronically” and Rule 36 “Exemption From Fees”. These amendments entered into force on April 1, 2016.

According to the Rule 5, failure to meet the deadline of the electronic communication with WIPO has to be confirmed by submission of reasonable evidence such as:

  • communication error with WIPO;
  • communication error at the location of the interested party which may be explained by the extraordinary circumstances.

Moreover, communication with WIPO has to be renewed within 5 days after communication problem have been solved.

According to the Rule 36, a request for any changes concerning the address for correspondence, e-mail address, telephone, fax numbers and other contact information of the applicant or the owner became free of charge.

It is important to note that amendments regarding Rule 9 “Requirements Concerning the International Application” and Rule 24 “Designation Subsequent to the International Registration” of the Common Regulations under the Madrid Agreement and Protocol will enter into force approximately on November 1, 2016.
