Latvia has adopted a new law on the industrial property institutions and procedures which will enter into force on January 1, 2016

The new law on the industrial property institutions and procedures was adopted by Latvian Parliament on June 18, 2015 and was published on July 2, 2015. The Law relates to the functions of the Patent Office and Industrial Property Board of Appeal as well as some regulations with respect to patent attorney profession and will come into effect on January 1, 2016.

Section A of the Law determines the basic rules and procedures of the Patent Office in the IP sphere. Also, pursuant to the Law the Office will operate as self-financing organization, which means that the state fees will be replaced by a similar amount of the service fees.

Section B provides basic rules and procedures relating to the Industrial Property Board of Appeal organizational framework. The Industrial Property Board of Appeal will receive broader powers of autonomy. It should be noted that decisions of the Board of Appeal cannot be appealed to the Administrative Court. If the appellant is not satisfied with the decision, he should address to the Municipal Court of Riga.

Section C clarifies applicant’s right on representation in the Patent Office and the Industrial Property Board of Appeal. Moreover, the Law improves the professional status of the patent attorney. Particularly, the patent attorneys corporate organization “Latvian Patent Attorneys Association" will issue the code of conduct as well as take other national tasks related to the patent attorney profession.
