When obtaining IP protection abroad, one of the most important and cost-consuming issues associated with filing an application with a foreign Patent Office, is the translation thereof into the target language.
Being aware of the fact that appropriate translation of the application determines the results of patentability examination applicants go to expenses to make sure that they get a high-quality patent translation. As a rule, either a translation service company or a local IP company is used for this purpose.
However, it appears that the majority of the translation service companies do not have specialists with corresponding technological background to understand a subject matter of a patent application. Besides, due to the broad variety of text types to be translated translation service companies may not be familiar with those patterns and templates that should be used when translating patent documentation. As to IP companies, they may simply lack for professionals with profound linguistic skills.
As a consequence, the choice of an inexperienced translator may lead to numerous office actions on the stage of the substantive examination, requiring extra time and costs, and affect the patentability of an invention. Furthermore, a translator's misunderstanding may cause a misrepresentation of a subject matter of an invention and, having obtained a patent, a patentee does not realize that a technical content of a source patent application has been changed. Being sure of a strong protection of his invention and seeking a monopolistic market position, a patentee may get into difficulties in possible court hearings regarding his patent. Moreover, in some cases an improper translation may even make it impossible to obtain patent protection.
Therefore, it is essential that patent translation services are accurate, fast and skillful both in the field and the art of translation.
