Changes to official fees in the Republic of Belarus since January 1, 2016

Some aspects of fee payment in the IP protection field were changed according to the amendments to the law of the Republic of Belarus “On amendments and additions to some laws of the Republic of Belarus on issues of entrepreneurship and taxation” and became effective on January 1, 2016.

The amendments affected the following:

The discount provided for applicants being natural persons for filing Eurasian patent application, its formal examination and transmittal to Eurasian Patent Organization (EAPO), as well as for transmittal of international application materials to the World Intellectual Property Organization (WIPO) was revoked.

Also, among the fees concerned is the process of license registration. Starting from January 1, 2016, the official fee is paid not for registration but for application processing license agreement, agreement on patent assignment for invention, utility model, industrial design, plant variety, trademark, topography of integrated circuits, pledge agreement of property rights attested by trademark certificate, franchise agreement, amendments to the mentioned agreements, and termination of a franchise contract. Consequently, the official fee for these services will not be refunded in case of refusal to execute the mentioned procedures.

Moreover, additional fee is determined in case of amendments to above agreements being associated with granting of the patent right or license.
