Protocol on the Protection of Industrial Designs in Eurasia

Diplomatic conference on adoption of Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention was successfully held today, on September 9, 2019. According to the Protocol, the procedure for obtaining a patent for industrial design in the EAPC countries will be centralized. That means filing single application with one Patent Office and prosecuting the application directly with the EAPO.

The draft protocol states that the validity term of a patent for Eurasian industrial design will be 5 years with the possibility of its renewal for subsequent 5-year periods. The maximum design protection period will be 25 years from the filing date of the Eurasian application.

We would like to remind you that the Eurasian Patent Convention includes the following member-states: Russia, Belarus, Kazakhstan, Armenia, Tajikistan, Azerbaijan, Armenia and Kyrgyzstan. The application for registration of Eurasian industrial design should be filed and prosecuted through a registered Eurasian Patent Attorney before the EAPO.
