Patent Registration in Ukraine
For filing a Ukrainian patent application we need the following:
Required filing documents
- Full name and address of the applicant(s);
- Full name and country code of residence of the inventor(s);
- Detailed description of invention with claims, abstract;
- Drawings (if any);
- Priority number, date and country of the first application, if convention priority is claimed (certified copy of the first application can be submitted within three months from the filing date);
- International publication, international search report, international preliminary examination report for entry of PCT application into national phase*;
- Simply signed Power of Attorney (legalization and notarization is not required; can be submitted within two months from the Official Request).
* Time limit for entry of PCT application into national phase is 31 months from the priority date. The application should be filed together with the Ukrainian translation thereof and official filing fee. (The term can be extended for two months on condition of payment of additional official fee).
Overview of the Patent Registration Procedure
-After completion of filing procedure the application undergoes formal examination within 2-3 months.
- On condition that the applicant has filed all required documents, the notification about positive result of formal examination is issued.
- On the applicant’s request, which can be filed within 3 years from the filing date, the substantive examination is conducted.
-If the invention meets the requirements of protectability, the grant decision is issued.
-If the registration and publication fees are paid in due course (within 3 months from receipt of the decision) the patent is issued.
-The total term of the invention registration is from 2 to 6 years.
