PATENT IN TURKMENISTAN

Patent protection in Turkmenistan may be also obtained via Eurasian patent.

The validity term of a Patent in Turkmenistan is 20 years from the filing date. For pharmaceutical patents and patents for agrochemicals it is possible to apply for extension of this term for 5 years. In case the patent is extended the Supplementary Protection Certificate (SPC) is issued.

The novelty grace period term is 6 months from disclosure of the information on invention.

Overview of the Patent registration procedure in Turkmenistan:
In Turkmenistan it is possible to obtain two types of patents, namely:
- the Limited patent (valid for ten years),
- or the Patent (valid for twenty years).
After completion of filing procedure the Turkmen patent application undergoes the formal examination within 3 months and limited examination within 6 months. After the limited examination is completed the decision of possibility to grant the Limited patent is issued. To obtain the Patent (valid for twenty years) the applicant should file the request for suspension of issue of the Limited patent and request the substantive examination within 5 years from the application filing date. With this aim, the applicant should submit a copy of a patent or decision to grant a patent for the parallel patent application in any country, in which the substantive examination is carried out by the Patent Office. After payment of grant fee and the first post grant annuities the patent is issued.

The procedure of the patent registration in Turkmenistan takes from 1 to 6 years depending on the type of patent chosen.

Foreign applicants must be represented before the Office by a registered Turkmen patent attorney.

For filing a patent application in Turkmenistan we need:
- your filing instructions with applicant’s and inventor’s name, address and citizenship;
- filing number and date of priority application or PCT application;
- specification with claims, abstract and drawings;
- copy of the amendments, if any;
- Power of Attorney simply signed and stamped by the applicant(s), legalization and notarization are not required (may be provided to the Turkmen Patent Office within 2 months from filing the application);
- for conventional applications - Certified copy of the priority document if priority is claimed (may be provided to the Turkmen Patent Office within 3 months from filing the application).

The term for entering the Turkmen national phase of PCT application according to Chapter I (Under PCT Article 22(1)) is 30 months from the priority date. The term for entering the Turkmen national phase of PCT application according Chapter II (Under PCT Article 39(1)) is 31 months from the priority date. The term for filing a conventional patent application in Turkmenistan is 12 months from the priority date.
