Amendments to the Statute on Fees of the Eurasian Patent Organization enters into force on January 1, 2017

Amendments to the Statute on Fees of the Eurasian Patent Organization enters into force on January 1, 2017. According to such amendments the fees payable in respect of the Eurasian application will be increased by about 15 percent. Besides the fee structure has also been slightly amended. Specifically, earlier the Eurasian legislation stipulated fixed filing fee for the fist five claims with the excess claim fee starting from the 6th. Right now the official fee for each claim in excess of the 5th has become not unified as it was before, but differentiated, i.e. the official fee is increasing with the increase of number of claims. Official examination fees structure has also changed, specifically, earlier there was cap for the official examination fee, i.e. only first five independent claims were chargeable. Right now official examination fee is paid for each independent claim.

Another significant change relates to the discount policy. Specifically, earlier stipulated discount on the official fees for the applicants natural persons from countries with per capita national income below 3000 USD and for all applicants from the least developed countries in the amount of 80 percent was reduced to the 50 percent discount. The discount earlier available for applicants from participating EAPC countries remains unchanged and constitutes 90 percent from the amount of official fees.
