Amendments in Belarusian legislation

New decree of the Council of Ministers of the Republic of Belarus about amendments in legislation ¹119 came into effect on August 20, 2014.

New paragraph about procedure of patent application, conducting examination and issuing the decision based on examination results was adopted by Decree of the Council of Ministers of the Republic of Belarus ¹119 as of February 2, 2011. According to the above-mentioned paragraph the environment of wild animal or plant should be specified when the invention relates to the substance or biotechnological product that is extracted from the wild plant or animal, and also when invention relates to the method where this substance or biotechnological products are used.

This decree was issued for implementation of The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological to which Belarus acceded from May 22, 2014. According to this protocol an access to genetiń resources and their usage is regulated on the basis of obligatory concurrence with the party that represents same resources.
