Accession of the Republic of Belarus to the Patent Law Treaty (PLT)

On July 13, 2016 the President of the Republic of Belarus signed the Law of the Republic of Belarus "On accession of the Republic of Belarus to the Patent Law Treaty.

The Law adopted in Geneva on June 1, 2000 is one of the laws functioning under the aegis of the World Intellectual Property Organization and determining the internationally agreed basic standards of protection for intellectual property rights. Specifically, said Law provides for:

  • harmonizing formal requirements set by national and regional patent offices;
  • optimizing procedures for obtaining patents and maintaining them in force;
  • establishing of a single set of formal requirements for applications for patents for inventions, simplification of some procedures in patent offices, etc.

With accession of the Republic of Belarus the Treaty now contains 37 states. Accession of the Republic of Belarus to the Treaty will provide applicants and patent holders with additional guarantees when considering the application for obtainment of a patent, such as, for instance, right to petition for an extension of the time limits, notification of failure to meet the procedural requirements of the application and other.

The law was officially published in the National Legal Internet Portal of the Republic of Belarus on July 16, 2016 and entered into force in ten days after its official publication, i.e. on July 26, 2016.
