Amendments to the Regulations on patent and trademark fees in Russia

According to the Resolution No. 1023 of November 14, 2013 of the Government of the Russian Federation there have been adopted amendments to the Regulations on patent and trademark fees in Russia.

Major change is associated with the fees on International PCT applications when the Russian Patent Office is chosen as a competent International Searching Authority and International Preliminary Examining Authority. Namely, in view of the fact that the proceedings on the international application may be conducted not only in Russian, but also in English which increases the cost of services provided by the Russian Patent Office there has been made a significant increase of the corresponding official fees for International Search and Preliminary Examination if proceedings are conducted in a foreign language. Earlier the fees were the same regardless of the language of prosecution.

In connection with the establishment of the Court for intellectual property rights in Russia, the consideration of cases for early termination of the legal protection of trademarks in connection with their non-use has been transferred to the jurisdiction of the Court for intellectual property rights and is carried out within the framework of the Arbitration Procedure Code of the Russian Federation. This entailed the exclusion of the corresponding fee from the Regulations.

The resolution No. 1023 came into force on November 29, 2013.
