Amendments to the criteria for granting discount on official patent fees when obtaining a Eurasian patent

According to the changes to the Rule 40 (4) of the Patent Regulations under the EAPC, which entered into force on 1 January 2015, there were introduced amendments to the criteria for granting discount on official patent fees when obtaining a Eurasian patent.

Specifically, under the new wording of this rule, the discount on official fees is available only for natural persons who are citizens of the countries where per capita national income is less than $ 3,000. Legal entities from said states are no longer entitled for the reduced rate, except for those states which are recognized by the United Nations as the least developed. The list of countries is mentioned in accordance with the corresponding list referred to by the Patent Cooperation Treaty when determining applicant entitled to the discount for filing PCT applications which can be found at the following link http://www.wipo.int/export/sites/www/pct/en/fees/fee_reduction.pdf

Those applications and patents that were received by the Eurasian Patent Office before January 1, 2015 and which applicants were entitled to the discount at that time can proceed to pay official fees with the earlier stipulated discount. For all other cases, with effect from 1 January 2015, the right to the reduced rate shall be determined in accordance with the current version of Rule 40 (4) of the Patent Regulations under the EAPC.
