The Agreement on Trademarks, Service Marks and Appellations of Origin of Goods of the Eurasian Economic Union (EAEU) of February 3, 2020 entered into force on April 26, 2021. According to the Agreement, the regional procedure of the trademark registration will become available in the member states of the Union (Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia).

Among the advantages of the regional trademark registration in the EAEU are the centralized filing of the application (online or on paper) and further prosecution in one IP Office. This procedure will be more cost-effective and faster than filing applications for the trademark registration in all member states of the Union separately.

The EAEU trademark application will undergo a preliminary examination and examination of the clamed designation. During the preliminary examination, the correctness of the application and the availability of a document confirming the payment of the fee will be checked. Further, the application will be published by the receiving Office and sent for examination of the claimed designation to the rest of the Offices of the member states of the Union. In the course of this examination, the trademark will be checked as to compliance with the conditions of the legal protection, and the applied designation will be checked for identity and similarity with previously registered/filed trademarks.

If the IP Offices do not receive any objections from third parties against the registration of a trademark, or they will be overcome, and if the examinations will be successfully completed, the trademark will be registered and the registration certificate will be issued.

The period of validity of the Eurasian Economic Union trademark will be 10 years from the date of filing of the application and can be renewed an unlimited number of times at the applicant's request (subject to the appropriate fee payment).
