Geographical indication is the new type of IP rights in Ukraine

On October 9, 2019 the President of Ukraine signed the Law "On Amending Certain Legislative Acts of Ukraine Regarding Improving the Legal Protection of Geographical Indications" No. 123-IX, adopted by the Verkhovna Rada of Ukraine on September 20, 2019. According to the Law geographical indication is implemented into Ukrainian legislation as a new type of intellectual property rights.

The term "geographical indication" in the new Ukrainian legislation means the name of a place that identifies a product that originates from a certain geographical region and has a special quality, reputation or other characteristics, mainly due to this geographical place of origin, and at least one of the stages of its production (manufacture (mining), and/or processing, and/or preparation) is carried out in a specific geographical area.

This Law is adopted to harmonize national legislation with European legislative standards in the framework of Ukraine's European integration. Once the new Law comes into force, attention will be paid to goods that currently violate the rights of geographical indications registered abroad (e.g. cognac, feta, parmesan).
